Terms and Conditions

1. ACCEPTANCE

LifeTips shall have the sole right, in its discretion, to accept or reject any application. The decision of LifeTips with respect to any application shall be final and binding. I understand that my application will be reviewed in a reasonable time frame, typically within one week of completion of the application. I understand and agree that LifeTips has the sole right in its discretion to change the review time period.

2. COMPENSATION

If my application is accepted, I understand and agree that I will complete a 101 Tip Book and be compensated $2 for every book sold. I also understand that I will be eligible for paid writing assignments with clients of WriterAccess that may pay up to $10 per tip and $100 or more per article that is approved by our editors, based on completion and client satisfaction. I also understand that beginning in January of 2009 and/or after a 3-month trial basis, I may be eligible for commission payment on advertising revenue earned on the Tip Site and Blog pages published on my Tip Site at LifeTips. The commission rate for advertising revenue may vary and change based on performance and other factors at that time. I also understand that my income earned at LifeTips may vary for a variety of reasons, including the quality of the content I submit, the traffic of my Tip Site, and marketing savvy on my part in promoting my site. I understand that to receive any compensation, and to continue on with the LifeTips program, any content I submit must be original, proven, tested, safe, sourced and validated. I also understand my obligation to create blogs regularly and fresh content for my subscribers and readers. At least 20 tips and/or blog posts must be uploaded every month.

3. ETHICS

I understand and agree that my application to the LifeTips Guru Program includes a biography, experience summary and sample tips that are original, authentic, factual and are proper representations of my past experience and sample tips completed by me. If my application is accepted, I understand and agree that all content I submit will also be original and unique, free of copyright infringement, well-researched and factual, and upheld by the latest professional standards. I understand that plagiarism, misleading or false information, or failure to comply with copyright laws will result in immediate termination from the LifeTips Guru Program.

4. TECHNICAL

If my application is accepted, I understand that I may encounter technical issues and problems using the LifeTips publishing tools. All technical problems will be resolved as soon as possible when LifeTips is notified of such problems.

5. OWNERSHIP

Any tips or content you submit to LifeTips, in any form, shall instantly become the property of LifeTips. This includes sample content submitted in your application if you are approved, as well as all content submitted to LifeTips. I fully understand and agree to these terms, with or without any compensation, and agree to a full release of my copyright claim for any content I submit to LifeTips.

6. EMAIL

If my application is accepted, I agree that LifeTips (including any of LifeTips' agents, employees or contractors) shall not be held responsible if I do not or cannot receive email messages from LifeTips. It is my sole responsibility to provide LifeTips a working email address and to ensure that email from LifeTips is not being filtered by spam software, my Internet Service Provider or other device or system that may prevent me from getting email.

7. TERMINATION

Either party may terminate this agreement at any time. LifeTips will compensate you for any balance due to you for agreed-upon compensation for the Guru Program, according to the terms and conditions of this agreement. Should you have published a book, you will continue to earn book commissions according to the terms and conditions in this proposal, but you agree to any future changes in the terms and conditions that may occur in the future.

8. ADDITIONAL TERMS AND CONDITIONS

If my application is accepted and I enter the LifeTips Guru Program, I understand and agree that there will be terms and conditions, policies and requirements that are in addition to these terms and conditions of this agreement. LifeTips shall have the sole right, in its discretion, to modify or change any terms and conditions, policies and requirements of the LifeTips Guru Program at any time. I further understand and agree that my continued participation in the LifeTips Guru Program will be deemed as my consent to, agreement with, and understanding of, such modifications or changes.

9. CHOICE OF LAW

These terms and conditions shall be governed by, and construed and enforced in accordance with, the laws of the State of Massachusetts, without giving effect to its conflict of laws provisions or your actual state or country of residence.

10. VALIDITY OF INTERNET/ELECTRONIC CONTRACTS

My agreements herein shall have the same meaning, force and effect as if executed by hand, and all of the laws to which a hand executed agreement are subject will govern these terms and conditions.

11. MISCELLANEOUS

If for any reason a court of competent jurisdiction finds any provision or portion of these terms and conditions to be invalid, void or otherwise unenforceable, the remainder of these terms and conditions will continue in full force and effect. Paragraph headings are solely for the convenience of reference and shall not be given any weight or effect in the interpretation or construction of the Agreements. These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these terms and conditions will be effective only if in writing and signed by LifeTips.
